Pueblo Colorado pays out $137,500 after jailing man for 2 days in case of mistaken identity

PUEBLO, COLORADO - The city of Pueblo has approved a six-figure payment to settle a civil lawsuit after a man was arrested and jailed in a case of mistaken identity.

Pueblo City Council approved the $137,500 payment to Dylan Carter at its Sept. 8 meeting after Carter filed a civil rights lawsuit against Pueblo Police Officers Seth Jensen and Richard Ruiz in their individual capacities.

The suit stemmed from Carter’s arrest in 2023, which came after Pueblo police filed an arrest warrant for the wrong man.

“On April 30, 2023, Mr. Carter was arrested on a warrant meant for someone else,” Carter’s attorney Ed Hopkins said in a written statement to the Chieftain. “He spent two days in jail because the arresting officers relied on incorrect identifying information. Losing two days of liberty is no small matter.
